Abstract

This study aims to determine the factors that influence the failure of divorce mediation at the class 1B Kudus Religious Court. This research was conducted because of an increase in divorce in Kudus. It is hoped that this research will be able to find out what are the factors that influence the failure of divorce mediation at the class 1B Kudus Religious Court. The method used is a qualitative method. Data collection techniques used are interviews and bibliographical sources. Interviews were conducted with two non-judge mediators who served at the class 1B Kudus Religious Court. The library sources used are scientific journal references. The results of this study obtained some information about the factors that influence the unsuccessful divorce mediations at the Kudus Religious Court Class 1B. Among these factors ate the unanimous determination of the parties, the level of education of the parties, the unfairness of the parties in the mediation process, the perspective of mediation is coercion and the lack of mediators.

Abstrak

Penelitian ini bertujuan untuk mengetahui factor-faktor yang mempengaruhi ketidakberhasilan mediasi perceraian di Pengadilan Agama Kudus Kelas 1B. Penelitian ini dilakukkan karena adanya peningkatan perceraian di Kudus. Dengan harapan penelitian ini dapat mengetahui apa saja factor-faktor yang mempengaruhi ketidakberhasilan mediasi perceraian di Pengadilan Agama Kudus Kelas 1B. Metode yang digunakan yakni metode kualitatif. Teknik pengumpulan data yang digunakan ialah wawancara dan sumber kepustakaan. Wawancara dilaksanakan dengan mediator non hakim yang bertugas di Pengadilan Agama Kudus Kelas 1B. Adapun sumber kepustakaan yang digunakan dari reverensi jurnal ilmiah. Hasil dari penelitian ini memperoleh beberapa informasi tentang factor-faktor yang mempengaruhi ketidak berhasilan mediasi perceraian di Pengadilan Agama Kudus Kelas 1B. Diantara faktor-faktor tersebut ialah tekad yang bulat dari para pihak, pola fiikir para pihak, ketidakhadilan para pihak diproses mediasi, perspektif mediasi adalah paksaan dan kurangnya tenaga mediator.
